Yup, some time ago (0.6.beta12).  People were complaining that 
[= ... =] didn't always work (especially around [[noheader]], [[nofooter]],
[[include]], etc), so I elevated it such that it now "always works".

Not at present -- we'd probably need a new markup for it.
