Hmm... I can see that point, and I have seen legal battles over software 
so the ability to sue is relevant... *but not for standard software*.
Having a contract is just one precondition for litigation; the other is 
having a cause. Standard software typically comes with a very general 
description of what it does, and the description is usually vague enough 
that you can't place any claims on them in court. (That the descriptions 
are vague has more reasons that just legal ones: you simply cannot 
precisely describe a software, at least not if you want to keep the 
document size manageable.)
